These terms explain the rules for accessing and using Ironhand SMS and its business messaging services.

1. Agreement to these terms

By creating an account, accessing the platform, or using our services, you agree to these Terms of Use and our Privacy Policy. If you use the service for an organization, you confirm that you have authority to bind that organization. If you do not agree, do not use the service.

2. Eligibility and accounts

You must be legally able to enter into a binding agreement and provide accurate, current account information. You are responsible for safeguarding credentials, activity under your account, authorized users, and promptly notifying us of suspected unauthorized access.

3. Messaging services

Ironhand SMS provides tools for contact management, campaigns, automation, reporting, API-based sending, and supported messaging channels. Features and channel availability depend on your plan, configuration, providers, destination countries, and applicable carrier requirements.

4. Consent and acceptable use

You may contact only recipients for whom you have a lawful basis and all consent required by applicable law. You must honor opt-outs promptly and maintain evidence of consent when required.

You may not use the service for unlawful, deceptive, abusive, harassing, discriminatory, fraudulent, or harmful activity; unsolicited messaging; malware; phishing; prohibited content; infringement; or attempts to bypass platform, provider, carrier, or regulatory controls.

5. Customer responsibilities

You are responsible for your contacts, message content, sending schedules, sender identities, campaigns, privacy notices, and compliance with laws and industry rules in every applicable jurisdiction. You must use suppression and unsubscribe controls appropriately and must not upload data you lack the right to process.

6. Fees, plans, and taxes

Fees, credits, limits, renewal terms, and included features are shown at purchase or in your account. You authorize applicable charges and are responsible for taxes unless a valid exemption applies. Third-party carrier or gateway fees may apply. Except where law or an applicable written policy requires otherwise, fees and consumed credits are non-refundable.

7. Availability and third parties

Delivery depends on telecommunications networks, carriers, gateways, recipient devices, and other third parties outside our control. We do not guarantee that every message will be accepted, delivered, opened, or acted upon. We may modify, suspend, or discontinue features for security, legal, operational, or provider-related reasons.

8. Intellectual property

Ironhand SMS and its licensors retain rights in the platform, software, design, and documentation. You retain rights in content and data you submit. You grant us the limited rights needed to host, process, transmit, and display that content solely to provide, secure, and improve the service.

9. Suspension and termination

We may restrict or suspend access when reasonably necessary to prevent harm, address security risk, comply with law or provider requirements, investigate suspected violations, or resolve non-payment. You may stop using the service at any time. Provisions that should reasonably survive termination will remain in effect.

10. Disclaimers and liability

To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties and do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages. Any limitation that cannot legally apply will be limited only to the extent permitted.

11. Changes and contact

We may update these terms to reflect service, legal, or operational changes. Material changes will be communicated through reasonable means, and continued use after the effective date constitutes acceptance where permitted by law.
